Terms of Service
Last updated
These terms govern your use of Who's Asking at usewhosasking.com (the “Service”). The Service is operated by Onur Garip, an individual based in Türkiye (“we”, “us”). By creating an account or using the Service you agree to these terms. If you don't agree, don't use the Service.
1. What the Service does
Who's Asking builds a Profile of your product from a link, searches public posts from people who may want that kind of product, scores them with AI, and drafts replies for you to review. We don't post anything for you, hold your social account logins, or take any action on a platform on your behalf.
Results are estimates. An AI model can misjudge a post or write something wrong, and search coverage is incomplete. We don't verify that a post is accurate, that its author is a real buyer, or that a thread is still open, and we don't promise any number of Opportunities, replies, clicks or sales.
2. Accounts
- You need a valid email address to sign in. You're responsible for activity on your account and for keeping access to your email secure.
- You must be at least 16 years old, and old enough to enter a contract where you live.
- One free preview per person. Creating accounts to collect extra free previews is not allowed.
3. What you post, and community rules
You decide whether to reply, what the reply says, and where it goes. Everything you post is yours, and so is the responsibility for it. That means you agree to:
- read and follow the rules of each community and platform where you post, including its rules on self-promotion, affiliate links and automated tools;
- review and edit each draft before posting it, and check that it's accurate;
- disclose your connection to a product whenever you mention it, and keep that disclosure if you edit a draft;
- not spam, harass or mislead anyone, and not contact people who have asked you not to.
Moderators and platforms can remove posts or restrict accounts for their own reasons. We can't prevent that and aren't responsible for it, even when you posted a draft unchanged.
4. Plans and payments
- New accounts get a free preview: one Scan and up to 6 Opportunities, once per account.
- Paid Plans are monthly subscriptions that renew until cancelled. Each Plan sets a Project limit and an Opportunity quota per billing period. Your count resets at the start of each period, and unused Opportunities don't carry over.
- If you reach your quota, Scans pause until your next period or until you upgrade.
- You can cancel any time. You keep access until the end of the paid period. After that, Scans pause and your data stays readable.
- Payments are processed by Polar (polar.sh), which acts as the merchant of record and handles billing, taxes and receipts. Polar's own terms apply to the purchase.
- We may change prices or quotas for future billing periods. We'll email you before a change affects your subscription.
Refunds
If something went wrong with a charge, email [email protected] within 14 days. We refund a charge for a billing period you haven't used. Periods that have been partly used may be refunded pro rata at our discretion. This doesn't limit any rights you have under consumer protection law.
5. Acceptable use
You agree not to:
- use the Service for anything illegal, or to promote products you're not allowed to promote;
- use it to profile, track, target or harass individuals, or for anything other than finding and joining public conversations about a product;
- scrape, resell or bulk-export the Service or the posts it finds, or access it through automation other than the features we provide;
- probe, overload or try to break the Service's security, or bypass its limits;
- impersonate others or misrepresent your relationship with a product.
We may suspend accounts that break these rules. If we suspend you without fault on your side, we'll refund the unused part of your current billing period.
6. Your content, drafts and public posts
You keep all rights to what you enter. You give us permission to process it to run the Service, which includes sending your Profile and Search phrases to the providers listed in our Privacy Policy.
You may use the drafts the Service generates for you, in your own business. Similar text may be generated for other people.
Public posts belong to their authors or platforms. We show them to help you find and reply to conversations. They aren't licensed to you for republishing or any other use, and how you use them is subject to each platform's terms and the law.
The Service itself, its software, design and brand belong to us.
7. Third-party services
The Service depends on providers such as a third-party social data provider, public APIs, Anthropic, Polar and Resend. Their outages or policy changes can affect results or availability, and any Source may become less complete or stop being available. We're not responsible for their services. Who's Asking isn't affiliated with or endorsed by any platform it searches, and platform names and logos belong to their owners.
8. Availability and changes
We aim to keep the Service running but don't guarantee uninterrupted availability. We may add, change or remove features. If we shut the Service down, we'll give at least 30 days' notice by email and refund the unused part of your current billing period.
9. Disclaimers and liability
The Service is provided “as is”. To the extent the law allows, we disclaim all warranties, including fitness for a particular purpose and the accuracy of AI-generated content and third-party data.
To the extent the law allows, we're not liable for indirect or consequential losses, lost profits, lost data, or action a platform takes against your account or content. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law, such as for intent or gross negligence.
10. Closing your account
You can stop using the Service at any time, and ask us to delete your account by emailing [email protected]. Cancel any paid Plan first, through the billing portal.
11. Governing law
These terms are governed by the laws of the Republic of Türkiye, and the courts of Türkiye have jurisdiction. If you're a consumer, you also keep the protection of mandatory laws and courts of the country you live in.
12. Changes to these terms
We may update these terms. For material changes we'll email you at least 14 days before they take effect. Continuing to use the Service after that means you accept the new terms.
